Using MiniWordPicture in header/footer

When placing the image in the header or footer it does not work.
placing image in the body of the document MiniWordPicture works fine.

I think the issue is how it adds the images:

var imagePart = mainPart.AddImagePart(pic.GetImagePartType);

This adds the relationships to the document.xml.rels, while header has its own relationship file linking the media and the reference in the xml (I tried manually adding a logo and it adds another header rels file).

I guess depending on which part of the document Generate runs on

docx.MainDocumentPart.HeaderParts.ElementAt(i).Header.Generate(docx, value); ;

It should add it to the header? I am pretty new at OpenXML though, so I haven't tested it out yet.
